The Office for Civil Rights Releases HIPPA Bulletin
April 20, 2020

The Office for Civil Rights (OCR) at the U.S Department of Health and Human Services (HHS) issued a bulletin to ensure that entities covered by civil rights authorities keep in mind their obligations under laws and regulations that prohibit discrimination on the basis of race, color, national origin, disability, age, sex, and exercise of conscience and religion in HHS-funded programs, including in the provision of health care services during COVID-19.

Community Hab/Respite During the School Day

After significant advocacy, OPWDD has agreed to allow families who have children in school with pre-authorized Agency Supported Community Habilitation, Self Hired Community Habilitation, and Respite to use these services during the school day. 

This only applies to those with approved services, not for new service requests. Formal Guidance from OPWDD on this issue is forthcoming and provider agencies are being notified of this change.

Applicable only during the COVID-19 crisis.

Dear Partner Providers:

As the COVID-19 (Coronavirus) situation evolves, LIFEPlan CCO NY remains committed to keeping our provider partners informed.

The State (OPWDD and DOH) has provided correspondence and agreed to provide relief for Life Plan deadlines, retroactive to March 7, 2020. 

  • All Life Plan due dates will be extended. The current Life Plan will remain in effect curing the NY State Emergency. Life Plan meetings are not required to be held. Care Managers are not being required to develop new annual Life Plans during this time.
  • For new enrollees, the initial Life Plan due date will also be extended. Service Authorizations for new enrollees will be reviewed with the Regional Offices, who will approve and advise what, if any, documentation may be needed in place of a Life Plan.

LIFEPlan CCO NY continues to monitor and assess the evolving COVID- 19 (Coronavirus) pandemic. We want to keep our provider partners abreast of the work that we are doing with OPWDD, DOH (Health Home Department) and our CCO partners.

LIFEPlan is proactively planning for the care of our members during this difficult period and has adjusted our policies to ensure the safety of our stakeholders.

Health Homes are Essential Businesses

March 23, 2020

Per the Governor’s Executive Order, CCO Health Homes fall within designated Essential Businesses, and Care Management Staff are essential workers.

Updates to Telecommunication

March 23, 2020

Care Managers will continue to use videoconferencing and phone conferencing with our members. However, the OPWDD guidance has allowed for the use of everyday non-public facing technology.

Provider Guidance

March 23, 2020

Effective 3/19/2020, OPWDD has directed that Community Habilitation can be conducted by alternative means. Alternative means can include conducting services by telephone or teleconferencing services.
