A “no” doesn’t have to be the final answer. Everyone has the right to ask questions, challenge decisions, and get support navigating systems.
Denied a Service or Benefit? You Have Options.
If you or your loved one has been denied services by OPWDD, Medicaid, Social Security, or insurance, you have the right to appeal. You are not alone.
Support is available to help you:
- Understand decisions
- Request reviews or fair hearings
- Gather paperwork in support of your appeal
- Advocate for your needs
- Find alternative ways to help meet your needs

You can also access Disability Rights New York, an independent, nonprofit organization that serves people with disabilities. Its core mission is to protect and advance the civil and human rights of New Yorkers with disabilities so they can live safely, make their own choices, and fully participate in community life.
Additionally, students with disabilities in New York State have a right to receive a free and appropriate education through the public school system. This means:
- Instruction and supports must meet the student’s individual needs
- Services and supports must help the student access and benefit from education
- Families and students have a right to ask questions, request supports and participate in decisions.
👉If you are unsure whether a student’s educational rights are being met or if you need help understanding or accessing services, reach out for support. You do not have to navigate this alone. There are educational advocates that understand the federal regulations and can support you in collaborating with the school district. Talk to your Care Manager or Member Relations if something doesn’t feel right.
